Terms and Conditions
Please read all the terms and conditions You must read all the terms and conditions to make sure you are happy they contain everything you require from this transaction. We can then accept your order and make a legally enforceable agreement.
Application
1. These terms and conditions will apply to the purchase of goods by yourself from us TLBS Vinyl Design (sales@tlbsvinyldesign.co.uk)
2. These are the conditions by which we sell our goods to yourself. By ordering any of our goods you agree to be bound by these terms and conditions.
Goods
3. The description of the goods is set out in our website TLBSVinyldesign.co.uk, our Ebay page ‘littlebobbinshop’, and both of our Facebook pages ‘TLBSVinylDesign’ and ‘TheLittleBobbinShop’. Please bear in mind there may be minor discrepancies in the sizes advertised and the colour supplied.
4. In the case of a custom/personalised order it is your (the customer) responsibility to provide accurate details. We will endeavour to provide a proof for approval before dispatch of a custom order but if the timeline does not allow for this the order will be made and dispatched as per the details provided.
5. All goods appearing on our selling venues are subject to availability.
Basis of sale
6. The description of goods on our website does not constitute a contractual offer to sell the goods. When an order has been placed on the website we can reject it for any reason, although we will try to give you a reason without delay.
7. The order process is set out on our website TLBSVinyldesigns.co.uk . Each step allows you to check and amend errors along the way before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
8. A contract will be formed for the sale of goods ordered only when you receive an ‘order confirmation’ email from us. You must ensure that the order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by yourself. By placing on order you agree to us giving you confirmation of the contract by means of an email (Order confirmation). You will receive the order confirmation within a reasonable time after ordering this will be no later than the delivery of any goods.
9. Any quotation is valid for a maximum period of 7 days unless we expressly state otherwise.
10. No variation of the contract, either description of the goods, fees, costs, charges, can be made after it has been entered into unless the variation is agreed between yourself and TLBS Vinyl Design via email or in writing.
11. These Terms and Conditions apply only to a contract entered into by you as a consumer. If this is not the case please inform us so we can provide you with a different contract with terms and conditions which are more appropriate for you thus giving you rights as a business.
Price and Payment
12. The price of goods and any additional delivery or other charges is that set out on the Website at the date of the order or a the price laid out in any prior written conversation agreed with us.
13. Prices and charges include VAT at the rate applicable at the time of the order.
14. You must pay at the time of submitting your order by any of the means laid out on TLBS Vinyl Design.
Delivery
15. We will deliver the goods to the delivery location without undue delay.
16. We do not generally deliver to addresses outside England, Scotland, Wales, Northern Ireland, the Isle of Man and the Channel Islands. If however we accept yourorder for delivery outside of those areas you may need to pay an impost tax which is your responsibility and we will not pay them or reimburse for them
. 17. You agree that we may deliver your goods in instalments if we suffer a shortage of stock or another genuine and fair reason. No extra expense will be incurred you you the customer should this happen we will cover all extra delivery charges.
18. If you the customer or your nominee fail, through no fault of ours, to take delivery of the goods at the delivery location, we will charge the costs of a redelivery.
19. The goods will become your responsibility after delivery or customer collection. Please examine the goods at your earliest convenience.
Risk and title
20. Risk and damage to or loss of any goods will pass to yourself the customer when the goods are delivered to you.
21. You do not own the goods until we have received payment in full.
Withdrawal, returns and cancellation
22. You can withdraw your order by telling us before the contract is made without incurring any liability.
23. This is a distant contract (as defined below) which has the cancellation rights set out below too. These cancellation right do not apply to a contract for the following goods. a. Goods that are made to your specifications or are clearly personalised;
Right to cancel
24. Subject as stated in these terms and conditions you can cancel this contract within 14 days without giving any reason.
25. The cancellation period will expire after 14 days from the day of receipt of the goods.
26. To exercise the right to cancel you most inform us of your decision to cancel this contract in writing. Either by post or email. Upon receipt of this in writing we will contact you via email with further instructions.
Effects of cancellation in the cancellation period
27. Except as set out below, if you cancel this contract we will reimburse you all payments received from you, including the cost of delivery (except for the supplementary costs arising if you chose an upgrade to the standard delivery offered by us)
Deduction for goods supplied
28. We may make a deduction from the refund for loss in value of the goods supplied. This could be down to unnecessary handling of the goods (handling more than might be reasonably allowed in a shop to establish the nature, characteristics and functioning of the item) This is because you are liable for the item after you took possession and any loss in function results in you paying for the amount of that loss.
Timing of reimbursement
29. If we have accepted the return in writing we will refund without undue delay no later than 14 days after receiving the goods back This refund will be done via the same means of the initial transaction.
Returning Goods
30. If you are returning goods you must send them back to the address provided without delay and in any event no later than 14 days from the day on which you communicated with ourselves your wish to cancel the contract. The deadline is met if you send the goods before the period of 14 days has expired. You agree that you will bear the cost of returning the goods.
Conformity
31. We have a legal duty to supply your goods in conformity with the contract and will not have conformed if it does not meet the following obligation
32. Upon delivery the goods will; a. Be of satisfactory quality b. Be reasonably fit for the purpose c. Conform to their description
33. It is not a failure on our part if its origins are in your materials.
34. We will provide the following after service: Application instructions
35. The supplier is not liable for loss of profit to the consumers business, trade, craft or profession as these losses would not be suffered by a consumer.
Governing Law and complaints
36. The contract is governed by the law of England and Wales.
37. We try to avoid any dispute so should a problem arise please contact us to find a solution. We aim to respond with an appropriate solution within 5 working days.
